Mr. Vikram Singh, Advocate for the petitioners Ms. Kirti Singh, DAG Haryana Mr. Narender Hooda, Senior Advocate with Mr. Sudhir Hooda, Advocate for respondent No.2 **** SURYA KANT, J. (Oral)  (1) The Sub Divisional Officer (Civil)-cum-Election Officer, Madlauda, District Panipat has filed written statement today reiterating on the basis of a fact-finding report dated 05.10.2015 and 01.01.2016 that the petitioners are actually residing in Madlauda and not in village Ahmedpur Majra.

(2) Learned counsel for the petitioners, however, contends that there is no factual basis for the above-mentioned report as the petitioners possess all the documentary proof in support of their being residents of Ahmedpur Majra.

(3) Since the writ petition raises more than one disputed questions of fact which can only be gone into by the authorities V.VISHAL 2016.01.12 14:59 I attest to the accuracy and authenticity of this document



          coupled with the fact that the petitioners need to be provided one fair opportunity to make out a case of their inclusion in the VoterList of Ahmedpur Majra (instead of Madlauda), the instant writ petition is disposed of with liberty to the petitioners to submit their appeal-cum-representation against the latest report dated 01.01.2016 before the Deputy Commissioner-cum-Election Officer and/or any other higher authority who shall redress the petitioners' grievances preferably before the ensuing Gram Panchayat elections, in accordance with law.
