Reply filed on behalf of respondent Nos.1 to 4 is taken on record. The exams are to take place tomorrow. I am convinced prima facie that the students cannot be put to any hardship by a stand off between the petitioner and the respondents. The counsel also produces before me a letter from the Government of India, Ministry of Labour and Employment to the Director, Directorate of Industrial Training and Vocational Education, Haryana dated 17.02.2015 that the petitionerinstitute is affiliated to NCVT for the two trades Fitter and Health Sanitary Inspector (HSI) and the State should release the seats for the trades to avoid any future complication.

On instructions from Sh. R.S. Saini, Assistant Director, the counsel for the State submits that in view of the fact that the State has PANKAJ KUMAR 2015.02.19 16:47 I attest to the accuracy and integrity of this document

CWP No.2763 of 2015 -2already released the seats only for SCVT for the two trades HSI and Fitter through its letter dated 06.08.2014 but the petitioner would claim that he has admitted students only for the two trades under NCVT programme, if the petitioner would give up the seats which were sanctioned under SCVT for the two trades as per the letter dated 06.08.2014, the State will not have any objection to have the seats released under NCVT. The petitioner states that he will not admit or seek for any permission for students for admission under SCVT pursuant to the letter dated 06.08.2014 for these two trades. In view of the submissions made by the respective counsel, the writ petition itself is ordered to be disposed of directing the respondents to release the seats for HSI and Fitter trades. The petitioner will also have the benefit of admission of students for Electrician trade under NCVT since at no point of time the State has allotted any seat under SCVT. 3.

The writ petition is disposed of. A copy of this order be issued to the counsel for the petitioner under the signatures of Special Secretary of this Bench.
