(Oral) The petitioners have approached this Court under Articles 226/227 of the Constitution of India, seeking a writ in the nature of Certiorari for setting aside the impugned sale notice dated 21st July, 2018 (Annexure P-1) issued by the respondent-Bank. A further prayer for staying the E-auction of the residential house of the petitioners during the pendency of the writ petition, has been made. It has been further prayed that in case the E-auction of the above mentioned property successfully proceeded, in that case, the sale confirmation of the said house may be stayed.

After arguing for sometime, learned counsel for the petitioners submitted that he may be allowed to withdraw the present writ petition with liberty to the petitioners to take recourse to the alternative remedies as may be available to them, in accordance with law.

Dismissed as withdrawn. It shall, however, be open to the petitioners to take recourse to the remedies as may be available to them, in accordance with law.
