The petitioner through instant petition under Articles 226/227 of the Constitution of India is seeking direction to the respondents to issue passport to him.

Learned counsel for the petitioner inter alia contends that petitioner at present is on bail and police till date has not presented challan against him and he is entitled to passport in terms of Office Memorandum dated 10.10.2019.

Mr. Deepanjay Sharma, DAG, Punjab, on instructions from ASI Swaran Singh, confirms that till date, challan has not been presented in FIR No.43 dated 23.02.2019 registered at Police Station City Faridkot District Faridkot, under Sections 420, 465, 467, 468, 471, 120-B of IPC. Ms. Neha Sharma, Advocate submits that the petitioner may be directed to appear before the passport authority along with requisite documents which would pass an appropriate order in accordance with law. 5.

It is undisputed fact that FIR stands registered against the petitioner, however, challan has not been presented. The petitioner is directed to appear before RPO, Amritsar along with requisite documents on 04.09.2023 at 11.00 a.m. On doing so, the passport authority would decide application of the petitioner in accordance with law within four weeks from 04.09.2023.
