(ORAL) The petitioner is seeking writ in the nature of mandamus for appropriate direction to respondent No.2-Deputy Commissioner to entertain and try the representation (Annexure P-2) alleged to have been submitted regarding taking action against Sarpanch Surjit Singh of Gram Panchayat of Village Chack Tahliwala, Tehsil and District Ferozepur with regard to embezzlement of lease money.

Learned counsel for the petitioner submits that the petitioner is the member of the Panchayat and having acquired the aforementioned knowledge as a diligent person, much less, the protector of the Panchayat, initiated the action by moving the representation, aforementioned, but no action has been taken on the same.

This Court called upon Mr. A.K. Sama to apprise this Court whether there was prima facie evidence to substantiate the complaint, the answer was none. Unless and until some information is provided with regard to the complaint, I am of the view that the said exercise is nothing but an outcome of animosity or nursing of grudge against the Sarpanch.
