Tribhuvan Dahiya, J (Oral) This petition has been filed seeking a writ of mandamus, directing respondent No.2/Commission to consider the petitioner's case after lapse of the date fixed for document verification for the post of TGT English pursuant to advertisement No.2 of 2023.

Learned counsel appearing for respondentNos.3 and 4 contends that provisional result of M.A. (English), re-appear examination, has been given to the petitioner on 28.07.2023. 3.

Learned counsel for the petitioner, by referring to Annexure P-5), contends that in this situation the respondents are bound to consider petitioner's eligibility since he now has higher qualification, i.e., MA AVIN KUMAR 2023.08.01 17:34 I attest to the accuracy and integrity of this order/judgment.t

2023:PHHC:097148 CWP No.15901 of 2023 [2] (English) in the same line as is the prescribed qualification, i.e., BA with English from a recognized university with atleast 50% marks in English as compulsory or honours subject, as per advertisement. 4.

Undisputedly, the closing date for submission of on-line applications after extension was 28.03.2023, and the petitioner was required to possess the requisite qualification or any higher qualification in the same line on the last date of submission of the application. Since he did not qualify MA (English) on that date, as the provisional result was provided only on 28.07.2023, he cannot be considered eligible in terms of the advertisement.

In view thereof, there is no ground to entertain the petition. 6.
