(ORAL) Learned counsel for the petitioner states that inadvertently the order dated 23.11.2007 passed by the DIG, Jalandhar Range, Jalandhar wherein it has been held that the period during which the petitioner had remained out of service will be treated as non-duty period, could not be challenged and therefore, he be allowed to withdraw this writ petition with liberty to file fresh one on the same cause of action by challenging the same.
