(ORAL) In the present petition, the challenge is to the conditions imposed in the promotion order of the petitioner that in case respondent No.3, who is otherwise senior to the petitioner, is exonerated in the disciplinary proceedings pending against her, she will be promoted by reverting the petitioner.

Thereafter, the petitioner filed a writ petition being CWP-57062016 wherein, a direction was given to the State to decide his claim whether, the respondent No.3 is eligible for promotion to the post of SATYAWAN 2024.09.06 16:08 I attest to the accuracy and integrity of this document

CWP-26824-2016 (O&M) Superintending Engineer or not. By a detailed order, the grievance of the petitioner has been addressed to mean that the disciplinary proceedings pending against respondent No.3 have been dropped and she was promoted to the post of Superintending Engineer by reverting the petitioner. The said order dated 17.09.2017 has never been challenged by the petitioner. 3.

Learned counsel appearing on behalf of the private respondents submits that respondent No.3 has already retired from the post of Superintending Engineer.

Learned counsel for the petitioner submits that the present petition may kindly be disposed of having been not pressed any further with liberty to challenge the order dated 17.09.2017 (Annexure R-1), in case, the same is permissible under law.

Ordered accordingly.
