***** JASPAL SINGH, J By virtue of instant petition preferred under Article 226 of the Constitution of India, petitioners have sought issuance of a writ in the nature of mandamus, directing the respondents to decide legal notice dated 02.07.2018 (P-7) in view of judgment passed by this Court in CWP No.16084/1997, 275/1998 and CWP No.4518/2000, which have attained finality vide order dated 11.08.2003 (P-4) and upheld by the Hon'ble Supreme Court vide order dated 08.12.2015 (P-5). And further to restore the deductions made from the payment of additional dearness allowance w.e.f. 01.05.1973 onwards along with arrears.

At the very outset, learned counsel for the petitioners submits that petitioners feel satisfied in case direction is issued to respondent No.2 to decide representation dated 02.07.2018 (P-7), within a stipulated period. Without expressing any opinion on the merits of the case, instant petition is disposed of with the direction to respondent No.2-Director, Health Departyment Haryana, Sector 6, Panchkula to consider the claim of the petitioners put forth by them in representation (P-7) and to take a conscious decision in the light of judgments referred to above in para No.1 of this judgment, within a period of three months from the date of receipt of certified copy of this order.

However, if the petitioners still feel aggrieved against any of the order passed by the concerned authority, they shall be at liberty to approach this Court as well as to have recourse to the other remedies available under law.
