The petitioner has approached this Court seeking grant of anticipatory bail in respect of a case registered against him vide FIR No. 384, dated 10.7.2020, Police Station City Ballabhgarh, District Faridabad, under Sections 420, 406 IPC.

At the time of issuance of notice of motion on 18.11.2020 the following order was passed:

"The learned counsel for the petitioner contends that the allegations in the FIR are that the complainant was duped of an amount of `26,400/- by one person, who

- 2 - offered to help the complainant to withdraw amount from an ATM.

The learned counsel for the petitioner submits that the petitioner is sought to be nominated as an accused on the basis of a disclosure statement allegedly made by one co-accused, Sabir, who is already on regular bail.

Notice of motion for 24.3.2021.

Meanwhile, in the event of arrest, the petitioner be released on interim bail subject to his furnishing personal bonds and surety bonds to the satisfaction of Arresting/Investigating Officer. However, the petitioner shall join the investigation as and when called upon to do so and cooperate with the Investigating Officer and shall also abide by the conditions as provided under Section 438 (2) Cr.P.C." 3.

Learned State counsel has informed that pursuant to interim directions issued on 18.11.2020, the petitioner has since joined investigation. It has also been informed that the matter is still under investigation and that the petitioner happens to be involved in one more case.

Having regard to the nature of allegations and the amount involved in the instant case and the fact that the petitioner is stated to have joined investigation, the petition is accepted and the interim directions issued by this Court vide order dated 18.11.2020 are hereby made absolute subject to the condition that the petitioner shall join investigation as and when called upon to do so and cooperate with

- 3 - the Investigating Officer and shall also abide by the conditions as provided under Section 438 (2) Cr.P.C.

The petitioner is directed to extend utmost cooperation for investigation of the case.
