Through instant petition, preferred under Article 226/227 of the Constitution of India, petitioner has sought issuance of a writ in the nature of mandamus directing the respondents to count the daily wage service period in the qualifying service from the period w.e.f. 01.01.1981 to 03.05.1993 (the day he was regularized).

At the very outset of the arguments, it has been submitted by learned counsel for the petitioner that matter can be disposed of with the direction to the respondent to consider the claim put forth by the petitioner in legal notice dated 11.08.2017 (P-1) and take a final decision thereon. 3.

Without expressing any opinion on the merits of the case, instant petition is disposed of with a direction to respondents to consider the claim put forth by the petitioner in legal notice dated 11.08.2017 (P-1) and to take a conscious decision, within a period of three months from the date of receipt of a certified copy of this order.
