(ORAL) Petitioner herein, inter alia, seeks issuance of a writ in the nature of mandamus directing the respondents to provide compassionate appointment to him against a suitable post according to his qualification or in the alternate to appoint him against the post of Sweeper-cum-Chowkidar under the Haryana Civil Services (Compassionate Financial Assistant or Appointment) Rules, 2019 framed by Government of Haryana. 2.

Learned counsel for the petitioner submits that the father of the petitioner died in harness on 25.01.2014. Mother of the petitioner, thereafter, moved an application dated 02.03.2014 for granting compassionate assistance. However, the same was not granted except the family pension. Learned counsel further submits that qua the aforesaid grievance, petitioner also submitted a representation dated 03.07.2020 (Annexure P-5), and he and his mother have been running from pillar to post since the death of his father, but to no avail. Hence, the instant petition. 3.

Learned State counsel, on advance service, joins proceedings and states that competent authority shall take appropriate decision on the pending representation dated 03.07.2020 (Annexure P-5). SHALINI BHATIA 2021.10.06 17:45 I attest to the accuracy and integrity of this document

At this stage, learned counsel for the petitioner also agrees that let a final decision is taken, either way, by the competent authority on the pending representation dated 03.07.2020 (Annexure P-5), giving reasons thereof.

Given the nature of order being passed, there is no necessity to seek return by any of the respondents as no further proceedings and/or pleadings are required.

Without commenting on the merits of the case, the writ petition is disposed of with a direction to the competent authority to look into the grievance of the petitioner as per representation dated 03.07.2020 (Annexure P-5) and also by keeping in view the contention raised in the present petition by treating the same as supplementary representation and take a decision, in accordance with law.

Let the needful be done within a period of 03 months from today. If a favorable order is passed, benefit thereof be accorded within 30 days thereafter.

Disposed of accordingly.
