CORAM:

HON'BLE MR. JUSTICE GURVINDER SINGH GILL Present :

Mr. Sandeep Kumar Bokolia, Advocate, for the petitioner.

(Proceedings conducted through video conferencing) ***** GURVINDER SINGH GILL , J .(Oral) The petitioner Sandeep Kaur seeks issuance of directions to respondents No.1 to 3 for taking legal action against respondents No.4 to 8, who are alleged to have given merciless beatings to her. Respondent No.4 is none else but husband of petitioner. It may here be clarified that infact in the array of parties Sandeep Kaur is mentioned as wife of Mahinder Singh, whereas infact she is daughter of Mahinder Singh and wife of Amritpal Singh.

The matter apparently seems to have arisen out of some matrimonial discord. Previously the husband of petitioner had approached this Court by way of filing CRM-M-31163 of 2020, wherein the following order was passed on 6.10.2020:

"The matter has been taken up through video-conferencing on account of lockdown due to outbreak of pandemic COVID-19.

-2Petitioner-Amrit Pal Singh, stated to be aged 35 years, has filed the present petition inter alia with a prayer for issuance of directions to respondents No.1 to 3 to take appropriate legal action against respondents No.4 to 9 on the basis of representation (Annexure P-1). Learned counsel for the petitioner submits that for the same/similar grievance as made in the petition, the petitioner had filed a representation dated 05.12.2019 (Annexure P-1) before The Commissioner of Police, Ludhiana, but till date, no decision has been taken. Notice of motion.

On asking of the Court, Mr. P.S. Walia, Assistant AG, Punjab, accepts notice on behalf of the State.

In view of the above, without commenting upon merits of the case, the present petition is disposed of with a direction that in case, the petitioner approaches the police authorities concerned, with above representation (Annexure P-1) or any other representation being filed before the Competent Authority concerned, the same shall be got examined by The Commissioner of Police, Ludhiana (respondent No.3), as expeditiously as possible preferably within two months from the date of receipt of copy of this order, in accordance with law and necessary steps as may be warranted under the facts and circumstances of the case, be taken thereupon forthwith. A copy of this order be sent by the Registry to The Commissioner of Police, Ludhiana (respondent No.3), through e-mail or any other mode, so as to enable the said authority to do the needful expeditiously. Ordered accordingly."

Having heard the learned counsel for the petitioner, the petition is disposed of with a direction to respondent No.2-Commissioner of Police, District Ludhiana, to look into the representation (Annexure P-2) filed by petitioner, while deciding the representation filed by Amritpal, which was ordered to be decided vide order dated 6.10.2020 (Annexure P-3). The petition stands disposed of with aforesaid direction. (GURVINDER SINGH GILL) 17.11.2020 JUDGE adhikari Whether speaking /reasoned Yes / No
