Laxmi v. Rajesh Kumar
IN THE HIGH COURT OF PUNJAB AND HARYANA
AT CHANDIGARH FAO-5183-2019 (O&M) Decided on : 01.11.2019 Laxmi ...... Appellant
Versus
Rajesh Kumar ...... Respondent CORAM : HON'BLE MR. JUSTICE RAJAN GUPTA HON'BLE MRS. JUSTICE MANJARI NEHRU KAUL Present :
Mr. V.K.Sandhir, Advocate for the appellant.
Mr. Tarun Sharma, Advocate for the respondent.
**** Rajan Gupta, J.
Present appeal is directed against the order dated 06.07.2019 passed by the Court below.
During the course of arguments, learned counsel for the appellant has limited his prayer to the extent that visitation rights to the respondent-father be granted at Amritsar instead of Phagwara. According to him, being a lady it would be difficult for the appellant to travel to Phagwara every time to meet the child to the respondent-father. Learned counsel appearing for the respondent has opposed the prayer.
Learned counsel for the appellant submits that the respondenthusband has moved an execution application on the pretext that the court below has directed that the respondent-father would be allowed to meet the child in Civil Court Complex at Phagwara on every 2nd and 4th Friday of every month from 1.00 pm to 5.00 pm.

FAO-5183-2019 (O&M) -2We however, feel that no such direction has been granted by the court below. In fact, the petition was dismissed as withdrawn. Needless to observe that when the main petition is dismissed, no interim direction can survive. To that extent, order under challenge would be inoperative. Consequently, the present appeal stands disposed of. (RAJAN GUPTA) JUDGE (MANJARI NEHRU KAUL) 01.11.2019 JUDGE sonia Whether speaking/reasoned:
