(ORAL) Through this petition under Section 482 Cr.P.C. prayer has been made for extending the time to deposit 20% of cheque amount for a period of six months against the judgment of conviction dated 16.07.2016 and order of sentence dated 20.07.2016 passed by the trial Court, whereby petitioner has been held guilty and sentenced to undergo simple imprisonment for a period of one year under Section 138 of the Negotiable Instruments Act (for short 'the N.I. Act'); he has further been ordered to pay compensation to the tune of cheque amount i.e. `11,79,250/- to the complainant and in default of payment of compensation, to further undergo simple imprisonment for a period of three months.

Petitioner has filed appeal before the appellate Court against the judgment of conviction and order of sentence wherein he is required RAVINDER SINGH 2022.08.30 16:27 I attest to the accuracy and authenticity of this order/judgment

-2CRM-M-38959 of 2022 to deposit 20% of the cheque amount under Section 148 of the N.I. Act. Learned counsel for the petitioner submits that petitioner is suffering from various ailments and is taking treatment from PGIMS, Rohtak. Therefore, due to financial problem he was not able to deposit the said amount before the Court. He may be granted some time to deposit 20% of the cheque amount with the Court.

Having heard learned counsel for the petitioner and after perusing the paperbook, present petition is being disposed of with a direction to the petitioner to deposit 20% of the cheque amount within eight weeks from today, failing which, this petition shall be deemed to have been dismissed.
