Learned counsel for the petitioner inter alia contends that the petitioner is the step son of respondent No. 1-Kamal Malhotra @ Babli, who has filed the petition under Section 125 Cr.P.C. despite the fact that respondent No. 2 (the real son of respondent No. 1) is alive. It is contended that the petition is not maintainable against the step son. 2.
After arguing for sometime learned counsel for the petitioner submits that he may be permitted to withdraw the present petition with liberty to approach the Family Court by way of filing an appropriate application.

Dismissed as withdrawn with the liberty aforesaid. 4.
