Prayer in this writ petition filed by the petitioner under Articles 226/227 of the Constitution of India, is for issuance of a writ in the nature of mandamus, directing the respondents to convert the Daily Wages service of the petitioner (on joining 5/1989 and retired as ALM on 31.03.2023) into Work Charge T-Mate service from the date of similar situated employee Sh. Pritraj (retired on 31.08.2023) and Surinder (retired on 31.08.2020) were converted as work charge T-Mate i.e. 04.03.1996, in view of the respondent's Circular dated 10.06.1996 (Annexure P-2) and thereafter, grant benefits of regularization/promotion as Assistant Lineman (ALM) and thereafter Lineman (LM) w.e.f. actual date of regularization/promotion of similarly situated employees and further to grant/release all consequential service/pensionary benefits including arrears thereof with interest @ 12% per annum. CWP No.17030 of 2024 (O&M) respondents to consider the past service of the petitioner as qualifying service for pension and to grant/release the pension including arrears thereof w.e.f. 31.03.2023 (date of retirement of petitioner) along with interest @ 12% per annum.

Learned counsel for the petitioner, at the very outset, confines his prayer for deciding legal notice dated 01.06.2024 (Annexure P-7). He submits that at this stage, petitioner would be satisfied, if the said legal notice is decided by passing a speaking order within a time bound frame.

On the asking of the Court, Mr. K.S. Kharbanda, Advocate, accepts notice on behalf of the respondents and has no objection to the innocuous prayer made by learned counsel for the petitioner. 5.

I have heard learned counsel for the parties and have gone through the record of the case.

Without going into the merits of the case at this stage, the present petition is disposed of with a direction to respondent No.1 to decide legal notice dated 01.06.2024 (Annexure P-7), submitted by the petitioner expeditiously, by passing a speaking order, preferably within a period of 03 months from the date of receipt of certified copy of this order.
