This petition has been filed under Section 528 of BNS for quashing of order dated 13.03.2023 passed by the ld. Sub Divisional Judicial Magistrate, Ellenabad (Annexure P-17) in complaint No. NACT/31/2020 dated 01.02.2020 vide which the petitioner has been declared as proclaimed person. 2.

Learned counsel for the petitioner submits that the petitioner was declared as proclaimed person vide order dated 13.03.2023 due to his non-appearance. All summons and warrants were issued against the petitioner at his native village where he was not residing , therefore, the same could not be received by the petitioner, following which Non-Bailable Warrants of arrest against the petitioner have been issued on 16.05.2022 and 21.12.2022. He further prays that the petitioner may be permitted to surrender before the learned trial Court to attend the trial proceedings regularly and, therefore, requests that the impugned order may be set aside.

I have heard the submissions made by the learned counsel for the petitioner and gone through the case file.

In view of the limited prayer made by the learned counsel for the petitioner, this Court deems it appropriate to decide this case without issuing notice to the respondent. This Court does not find any legitimate ground to interfere in the impugned order dated 13.03.2023 passed by the ld. Sub Divisional Judicial Magistrate, Ellenabad. However, in case the petitioner surrenders before the trial Court within 10 days from today at 10:00 A.M and move an application for grant of regular bail, on his doing so, the trial Court shall consider and decide the same on the same day. 5.

Petition stands disposed of.
