While praying for the issuance of a writ in the nature of certiorari to quash order dated 25.09.2017, the petitioner prays for direction to the respondents to reinstate her in service. The petitioner secured appointment on the basis of B.Sc. Degree from Eastern Institute for Integrated Learning in Management University, Sikkim. The University Grants Commission has informed that the aforesaid University was never authorized to impart education to grant B.Sc. Degree through distant education mode.

It has been brought to the notice of the Court that a similar writ petition filed by Devki Nandan and others Vs. Kurukshetra University, Kurukshetra and others, CWP-8062-2014, relating to the candidates who had got educational certificates from the University has already been dismissed vide judgment dated 17.12.2015.

A reading of the judgment shows that the Court after culling out two issues has held that the aforesaid University has no jurisdiction to open distant education centres and award such degrees. 4.

In view the aforesaid, no ground to issue the writ as prayed for, is made out.
