Prayer made in the present petition is for quashing of orders, Annexures P-3 and P-5 and for fixation of pay. 2.
Learned counsel for respondent Nos.1 and 3 refers to paras 7 and 8 of the short reply dated 18.07.2023 by way of affidavit of Principal, Govt. Model Senior Secondary School, Chandigarh, to which there is no rebuttal by filing any replication, which reads thus:- "7. That thereafter again clarification was sought vide letter dated 02.05.2017 from respondent No.2 and finally clarification was received vide letter dated 12.07.2017 and wherein it was stated that the pay be fixed notionally w.e.f. 16.05.2012. The copy of the letter dated 12.07.2017 is attached herewith as Annexure R-1.
8. That accordingly in view of the letter dated 12.07.2047 (Annexure R-1), the pay of petitioner was refixed vide Order dated 08.09.2017 and the copy of the same is attached herewith as Annexure R-2. It is further submitted that even the arrears were released.
It needs to be clarified here the deputationists are paid the pay scale which they are drawing in the parent cadre and further the Chandigarh Administration is liable to pay to the deputationist as per the Orders of Punjab Govt."
