* * * * S.J. VAZIFDAR, C.J. (ORAL) The petitioner has challenged the conditions contained in the Notice Inviting Tender (NIT).

The NIT was issued on 07.10.2016. The tenders were to be submitted between 10.10.2016 to 27.10.2016. The petitioner submitted his tender on the last date i.e. 27.10.2016. He filed CWP-23507-2016 only thereafter. The writ petition was disposed of by an order and judgement of a Division Bench of this Court dated 11.11.2016 directing the respondents to consider his representation. The representation was rejected by an order dated 06.12.2016. 3.
The period of the tender was only five months. The work was, therefore, to be completed by April/May, 2017. It is now over nine months since the work was completed. We, therefore, dismiss this petition without considering the merits of the case. It would be open to the petitioner to challenge the conditions if stipulated in other tenders, if necessary.
