(ORAL ) The present petition has been filed under Section 438 of the Code of Criminal Procedure for grant of anticipatory bail in FIR No.200 dated 6.9.2020, under Sections 323, 324, 326 and 506/34 IPC, registered at Police Station Sadar, Tohana, District Fatehabad. Learned counsel for the petitioners has submitted that in the present case even as per the contents of the FIR the only role attributed to petitioner No.1 is kick blow and so far as petitioner No.2 is concerned, he is minor and the only role attributable to him is of beating. CRM-M-37430-2020 (O&M) submitted that both the petitioners have been falsely implicated in the present case and the story put forward in the FIR is a concocted story. He has further submitted that co-accused of the petitioner have been enlarged on regular bail.

On 12.11.2020, while issuing notice of motion, the petitioners were granted interim protection subject to their joining investigation and abidance of the provisions of Section 438 (2) Cr.P.C. Today, learned State counsel, on instructions from HC Angrej Singh, has stated that in the present case in pursuance of the order of this Court dated 12.11.2020, both the petitioners have joined investigation and have fully cooperated with the investigation process. He has further submitted that the petitioners are no longer required for custodial interrogation.

In view of above statement made by the learned State counsel, the present petition is allowed. Interim order dated 12.11.2020, is hereby made absolute.
