JASWANT SINGH, J (ORAL) The petitioner was appointed as Clerk on 01.3.2002 on compassionate basis and his seniority was fixed in the Field Cadre. He, by filing the present writ petition, is seeking a writ of Mandamus for framing of a common seniority between the Clerical Staff of the Head Office and the Field Staff and thereafter promotion to the post of Deputy Superintendent Grade II. Upon notice, a reply by way of counter affidavit dated 13.5.2014 of Sh. Roop Kumar, Assistant Inspector General of Prisons, Punjab stands filed on behalf of respondent Nos.1 & 2. At the time of hearing, learned counsel for the petitioner submits that the present petition has become infructuous as a common seniority list has since been framed and the petitioner has also been considered for promotion on the basis of the said seniority list.
In the light of the statement made by learned counsel for the petitioner at bar, present writ petition is dismissed as infructuous.
