(ORAL) The petitioner is aggrieved of the impugned order dated 02.01.2017 (Annexure P-2) whereby the Additional Chief Secretary, Government of Haryana set aside the order of suspension of respondent No.4 and remanded the matter back to the Deputy Commissioner to pass a well reasoned speaking order in accordance with law.

The wife of the petitioner had also contested for the post of Sarpanch and election petition has already been filed. It is strange that both the husband and wife have adopted different methods in order to throttle the name of the elected candidate. Such type of procedure, in my view, is totally uncalled for. The order of Additional Chief Secretary, Government of Haryana holding that the impugned order does not show any reasons as to why the show cause notice was not found satisfactory is just and reasonable, particularly, when the election petition is already pending. Two remedies for the same case cannot be taken.

I do not intend to differ with the order under challenge, much less, no ground for interference is made out. The writ petition is dismissed.
