(ORAL) The permit granted to the petitioner could not be released on account of an interim order, dated 26.04.2013, passed by Hon'ble the Apex Court in SLP (Civil) No. 17238 of 2013 (Mini Bus Operators Association & others v. State of Punjab and others) and other connected matters. Admittedly, the said cases were finally disposed of by Hon'ble the Apex Court on 02.08.2016 and the interim order, dated 26.04.2013, ceased to exist.

CWP-5346-2013 The vital issue which needs to be examined is as to whether after the matter has attained finality upto Hon'ble the Apex Court, the petitioner would be entitled for release of the route permit or not. In such circumstances, we dispose of this petition by providing that the petitioner shall make a representation in this regard before the State Transport Commissioner, Punjab, who after examining the issue shall decide the question in light of the judgment of Hon'ble the Apex Court, expeditiously preferably within a period of two months from the date of making of the representation.
