Prayer made in the present petition is for directing the respondents to consider the case of the petitioner for deemed date of regularization as 23.02.1995 instead of 07.07.1995 and grant of one increment in terms of instructions dated 16.04.2012, Annexure P-9, as has been done in the case of Prem Chand, who was junior to him, on account of the fact that the regularization has to be granted after 2 years of service. The petitioner has retired on attaining the age of superannuation on 31.08.2023 and it is only at that time from the service book, Annexure P-4, he came to know of the aforesaid, with regard to which a legal notice dated 16.03.2024, Annexure P10, has been served upon the respondents, however the same has yet not evoked any response. He thus, at this stage, on instructions, from the petitioner, prays that a direction is given to the respondents to decide the same in a time bound manner.

At the asking of the Court, Mr. Harish Nain, AAG, Haryana accepts notice on behalf of the respondent-State and has no objection to the limited prayer made.

In view of the above and without commenting upon the merits of the case, this petition is hereby disposed of with a direction to the respondents to decide the legal notice dated 16.03.2024, Annexure P-10 expeditiously, in accordance with law.
