IN THE HIGH COURT OF PUNJAB AND HARYANA AT

CHANDIGARH CWP No. 5363 of 2013 Date of decision: 29.04.2016 Nirmal Singh ....Petitioner(s)

Versus

Punjab State Power Corporation Ltd. and others

...Respondent(s)

CORAM: HON'BLE MR. JUSTICE G.S.SANDHAWALIA

Present:

Mr. P.S. Dhaliwal, Advocate, for the petitioner.

G.S.SANDHAWALIA, J. (Oral) The petitioner seeks the quashing of the order dated 03.04.2008 (Annexure P-12). The grouse of the petitioner is that he should be considered for promotion w.e.f. 05.06.1991 (due date from which date, the junior respondent no. 4 was promoted as Oil Cleaner and not from 05.03.1992). Thus, the claim of the petitioner is that being senior to the said respondent, he was entitled for promotion from the date when the junior was promoted.

In the impugned order, the reason given for declining the relief is that the said respondent was working in a different circle and, therefore, the petitioner could not claim parity with the said employee. The petitioner belongs to Circle Bathinda and the said employee was from Circle Patiala. Counsel for the petitioner is not able to demonstrate that the seniority list is maintained at the State level.

In such circumstances, there seems to be no error in the impugned order. Accordingly, no relief can be granted to the petitioner and the writ petition is dismissed.
