**** SANJAY VASHISTH, J. (Oral) Petitioners namely Shashi and Rajinder Arya have filed the instant petition under Section 528 of BNSS, 2023, has been filed by the petitioner for issuance of direction to respondents No.1 to 4 to conduct fair and impartial investigation in Complaint Diary No.1161-SP dated 27.03.2026 (Annexure P-1).

On perusal of the complaint, clearly it seems to be a civil dispute because petitioners are recipients of the amount i.e. the earnest money being seller in pursuance to one agreement to sell with respondent No.5. Since the sale deed was not executed, as alleged on account of not paying the complete balance amount, counsel submits that one complaint had been moved by purchaser/respondent No.5 and the police is harassing him. Such matters cannot be examined by invoking powers under Section 528 of BNSS. However, alternative remedy is available to the petitioners for which they are always free to avail.
