The petitioner incarcerated for violating the above-mentioned provisions per the FIR captioned above, has come up before this Court under Section 439 CrPC seeking interim bail on medical grounds.

Petitioner's counsel submits that the petitioner had undergone operation because of carcinoma and his condition is very critical and therefore, he seeks at least 3 months extension of interim bail granted by the trial Court. He has referred to his medical record as well as previous orders passed by the Court in support his contention.

State's counsel could not oppose the authenticity of the medical record of the petitioner.

After carefully analyzing the matter and considering the medical history of the petitioner, this Court is of the considered opinion that the petitioner is entitled to ASHWANI KUMAR 2024.07.20 11:35 I attest to the accuracy and integrity of this order/judgment Punjab & Haryana High Court, Chandigarh

CRM-M-34642-2024   interim bail for three months.

Given above, without expressing any opinion on the merits of the case, provided the petitioner-accused is not required in any other case, the present petition is allowed and the bail granted by the Additional Sessions Judge, Sonipat is extended till 19.10.2024 at 10 a.m. on the same terms and conditions. The petitioner shall also be at liberty to seek further extension of interim bail in case his medical condition does not improve.

The petitioner shall surrender in prison from where he was released, on or before 19.10.2024, by 10 a.m.

There would be no need for a certified copy of this order for furnishing bonds, and any Advocate for the Petitioner can download this order along with case status from the official web page of this Court and attest it to be a true copy. In case the attesting officer wants to verify the authenticity, such an officer can also verify its authenticity and may download and use the downloaded copy for attesting bonds.
