Present petition has been filed under Article 226 of the Constitution of India for issuance of writ in the nature of Habeas Corpus for the release or produce the detenue namely Shakshi, daughter of the petitioner from the illegal custody of respondent No.5. 2.
In compliance of order dated 03.06.2025, status report by way of an affidavit of Sukhpal Singh, Deputy Superintendent of Police, Sub Division Nakodar, District Jalandhar has been filed on behalf of respondents No.1 and 3 in Court today and the same is taken on record subject to all just exceptions. As per reply filed by the State counsel, the detenue Shakshi has got married with respondent No.5 with her own sweet will and is living happily as his wife.

On being asked by the Court, detenue Shakshi has stated that she wants to stay with her husband (respondent No.5) and she has also showed her willingness to meet her parents. The statement of the detenue is reproduced as under:

love affairs with Hakam son of Satnam resident of Bal Nau resident of Bal Nau, Police Station Sadar Nakodar at present resident of Nala, Police Station Lambra, we both have solemnized our marriage with our free will on 26.05.2025 at Gurudwara Dashmesh Pita Patshahi Tenth village Singha Devi, Tehsil Kharar, Distt. Mohali by way of Anand Karaj and by apprehending danger from my family members father Balwant Singh, mother Neelam Kumari, uncle Vinod Kumar, Brother Ankit Thakur, friend Anil residents of Shankar, Distt. Hamirpur, Himachal Pradesh, have filed a writ petition no. CRWP 5730 of 2024 which was disposed off on 29.05.2025 and later on my father Balwant Singh filed a writ petition against me bearing writ petition no.
CRWP 5975 of 2025 in which my father Balwant Singh told that boy Hakam has kidnapped me abducted me whereas it is not true. I being major with my will has solemnized marriage with Hakam son of Satnam on 26-05-2025 at Gurudwara Dashmesh Pita Patshahi Tenth village Singha Devi, Tehsil Kharar, Distt. Mohali by way of Anand karaj and about this I produce you photocopy of certificate. We both as husband and wife are living in our house peacefully. Myself and my husband will appear before Judge Sahib at Hon'ble Punjab and Haryana High court at Chandigarh on 10.06.2025 and will make statements in this regard.sd-/" 4.
