29 petitioners compted for appointment to the posts of Masters/ Mistresses in different disciplines like Social Studies, Science, English/ Hindi/Punjabi pursuant to the advertisement dated 20.11.2015. The total number of advertised posts were 6060 for all streams and categories. All the petitioners belong to Scheduled Caste or Backward Class category and were seeking appointment against the posts advertised in their categories. Learned counsel for the petitioners states that there are number of posts of Masters/Mistresses in their discipline which are vacant and thus petitioners are entitled to be appointed against the said posts. After hearing learned counsel for the petitioners, no case for interference is made out.

The petitioners have not been able to show that based on their secured merit they fall within the zone of appointment against the advertised vacancies in their respective categories so as to have a legitimate right of appointment. It is a conceded position that no one junior to petitioners in Rajinder Parshad Joshi 2018.07.19 11:24 I attest to the accuracy and integrity of this document

CWP 23530/2017 merit has been appointed. It is also conceded that process of appointment/recruitment pursuant to advertisement dated 20.11.2015 stood closed vide public notice dated 1.9.2017. It is also conceded that thereafter a fresh advertisement dated 10.9.2017 was issued by the Punjab Government advertising the posts of Masters/Mistresses in different streams including the ones qua which petitioners are seeking appointment. Now at this stage no mandamus,whatsoever, of any kind can be issued in the facts of the present case.

Dismissed.
