**** HARNARESH SINGH GILL, J.(Oral) This petition has been filed under Article 226 of the Constitution for issuance of a writ in the nature of mandamus directing respondents No.1 to 3 to protect the life and liberty of the petitioners at the hands of respondents No.4 and 5.
Learned counsel for the petitioners states that both the petitioners are major and have married against the wishes of respondents No.4 and 5 and have sought protection to their life and liberty. They apprehend danger at the hands of respondents No.4 and 5. He further submits that petitioner No.1 was earlier married to Johny Sahni but vide judgment dated 22.03.2022 passed by Additional Principal Judge, Family Court, Jalandhar, the said marriage was dissolved and the minor daughter from the said marriage is residing with petitioner No.1. The photographs and certificate evidencing their marriage are on record as Annexures P-3 and P-4, respectively. CRWP-8066-2022 (O&M) -2dated 22.08.2022 (Annexure P-5) to respondent No.2-Senior Superintendent of Police, District Kapurthala. Notice of motion to respondents No.1 to 3-State only. On the asking of this Court, Mr. Subhash Godara, Additional Advocate General, Punjab, accepts notice on behalf of respondents No.1 to 3-State only.
Without entering upon an exercise to evaluate the evidentiary value of the documents placed on the file, I dispose of the present petition with a direction to respondent No.2-Senior Superintendent of Police, Kapurthala, to decide the representation dated 22.08.2022 (Annexure P-5) moved by the petitioners and grant protection to them, if any threat to their life and liberty is perceived. It is made clear that this order shall not be taken to protect the petitioners from legal action for violation of law, if any, committed by them.
