(ORAL) Prayer in the present petition under Article 227 of the Constitution of India is for setting aside order dated 06.04.2018 (Annexure P-4) passed by learned Judicial Magistrate 1st Class, Rohtak whereby the application filed by the petitioner for passing an interim order for residence, maintenance and litigation expenses has been partly allowed; AND judgment dated 28.01.2019 (Annexure P-5) passed by learned Additional Sessions Judge, Rohtak whereby the appeal preferred by respondent No.1 against the said order dated 06.04.2018 has been partly allowed and the amount of Rs.10,000/- as rent has been reduced to the extent of Rs.5,000/-. Vakalatnama filed on behalf of respondent No.1 in Court today is taken on record.

Learned proxy counsel for the petitioner submits that he may be permitted to withdraw the present petition with liberty to take recourse to the appropriate remedy as per law.
