The petitioner through instant petition under Articles 226/227 of Constitution of India is seeking direction to respondents to renew his passport.

The petitioner was issued passport on 25.01.1984 which was valid upto 24.01.1989. The petitioner never visited abroad and did not get renewed his passport. Now, son of the petitioner has settled abroad, thus, petitioner wants to visit abroad. The petitioner on 22.03.2023 applied for renewal of passport. The application of the petitioner has been withheld on the ground that criminal proceedings are pending against the petitioner. The petitioner was convicted in FIR No. 12 dated 09.04.2003, under Sections 7, 13(2) of Prevention of Corruption Act, 1988, registered at Police Station, Vigilance Bureau, PARAMJIT KAUR SAINI 2023.07.28 18:01 I attest to the accuracy and authenticity of this order/judgment

CWP No. 16058 of 2023 -2- 2023:PHHC:096345 Bathinda. The petitioner has preferred CRA-1720-SB of 2008 before this Court which is still pending. The sentence of the petitioner was suspended vide order dated 17.09.2008 passed by this Court. 3.

This Court vide judgment dated 14.07.2023 passed in CWP No. 27167 of 2018 has disposed of identical issue. 4.

On being confronted with the aforesaid fact, Ms. Neha Sharma, Advocate for Union of India concedes that facts of the present case are identical to case of Mohan Lal @ Mohna vs. Union of India and others, CWP No. 27167 of 2018.

The issue involved in the present case is squarely covered by judgment dated 14.07.2023 of this Court passed in CWP No. 27167 of 2018.

The instant petition stands disposed of in view of aforesaid judgment and passport authorities are directed to pass order in the same terms.
