IN THE HIGH COURT OF PUNJAB AND HARYANA AT

CHANDIGARH CWP No. 4521 of 2014 Date of decision : 10.08.2017 Sarita Mittal ....Petitioner V/s Life Insurance Corp. of India & ors.

....Respondents BEFORE : HON'BLE MR. JUSTICE RAJAN GUPTA

Present:

Mr. Neeraj Gupta, Advocate for the petitioner. Mr. Nitin Thatai, Advocate for respondents no. 1 to 3. RAJAN GUPTA J.

Grievance of the petitioner is that no opportunity of hearing was afforded to her before terminating her agency and forfeiting the renewal commission. No document was supplied to her to file her response to the allegations leveled against her. It is urged that petitioner has worked for Corporation for 14 years and achieved Chairman's Club Membership. Admittedly, Corporation is at liberty to terminate the agency of an agent. Only grouse which subsists is regarding payment of renewal commission. At the outset, Mr. Thatai, learned counsel appearing for the Corporation fairly submits that matter shall be reconsidered by respondent no. 3. Necessary documents shall be supplied to the petitioner and a fresh decision shall be taken regarding forfeiture of renewal commission. In view of statement made by counsel appearing for the Corporation, the orders Annexure P-9 & P10 are hereby set-aside. Matter is remitted to Zonal Manager for decision afresh in terms of the statement Ajay Kumar 2017.08.12 13:23 I attest to the accuracy and authenticity of this document
