Prayer in this writ petition filed under Articles 226/227 of the Constitution of India, is for issuance of a writ in the nature of certiorari, for quashing the order dated 19.06.2017 (Annexure P-4) passed by respondent No.2 vide which punishment of 75% of Rs.5,95,399/- taken by one Gurtej Singh son of Jasraj Singh, has been awarded against the petitioner. Further a writ of mandamus has been sought, directing the respondents directing respondent No.1 to decide the appeal filed by the petitioner against the order dated 19.06.2017 and to pay the deducted amount from the retiral benefit of the petitioner along with interest @18% per annum.

Learned counsel for the petitioner submits that he would be satisfied if the statutory appeal dated 19.06.2017 (Annexure P-5) of the petitioner, which is pending for the last eight years, is decided by the Appellate Authority/respondent No.2 by passing a speaking order in a time bound manner.

Learned counsel representing the respondent/Bank submits that he has no objection, in case a direction is issued to the Appellate Authority/respondent No.2 for time-bound consideration and decision of the statutory appeal dated 19.06.2017 (Annexure P-5) of the petitioner by passing a speaking order.

Therefore, in view of the limited prayer made by learned counsel for the petitioner, respondent No.2 is directed to consider the statutory appeal dated 19.06.2017 (Annexure P-5) of the petitioner and pass a speaking order, after affording an opportunity of hearing to the petitioner, within a period of 03 months from the date of receiving a certified copy of this order, strictly in accordance with law. Further, the decision taken thereof shall be conveyed to the petitioner. 5.

Disposed of, accordingly.
