*** Daya Chaudhary, J. (Oral) The difference between the cases in which directions have been issued to the State to dispose of representations praying for directions to remove an anomaly in the pay scales of ETT Teachers is that in the present case, the anomaly has been removed by the Government. However, the financial benefits resulting from removal of anomaly have not been computed and paid to the petitioners. One of the writ petitions is CWP No.1764 of 2014 in which the directions were issued against the State. The petitioners have served a legal notice dated 09.05.2016 (Annexure P-3) for the claimed unpaid dues after removal of the anomaly, but the same has not been considered and decided so far.
Learned counsel for the petitioner submits that he would be satisfied if a direction is issued to the respondents to consider and decide the legal notice of the petitioners in a time bound manner. Consequently, this petition is disposed of with a direction to the respondents to consider and decide the legal notice (Annexure P-3) within two months from the date of receipt of a certified copy of this order, by passing a speaking order. In case hearing is required, it may be granted to the petitioners within the time frame fixed. In case the position is as asserted by the petitioners, the matter being covered then there would be no need to waste time in hearing or passing a speaking order and the monetary usufruct be made over to the petitioners within 6 weeks and compliance report be filed in this disposed of matter for the perusal of the Court.
