The petitioner assails order dated 23.5.2024 (Annexure P-7) passed by learned Judicial Magistrate 1st Class, Ganaur, whereby her bail has been cancelled by the Trial Court on account of her absence on 23.5.2024, on the ground that the absence of the petitioner as on the said date was unintentional and as a matter of fact she had an anxiety attack and had been examined at Postgraduate Institute of Medical Education and Research (PGIMER), Chandigarh on 21.5.2024.

Learned counsel for the petitioner in support of his aforesaid contention has drawn the attention of this Court to Out Patient Department Card (OPD) (Annexure P-5) indicating that the petitioner had been examined in PGI, Chandigarh.

Having heard learned counsel for the petitioner, the instant petition is disposed of with liberty to the petitioner to surrender before the Trial Court and to apply for grant of regular bail.

In case, the petitioner surrenders before the trial Court on the next date fixed before it i.e. 24.7.2024 and applies for grant of regular bail, the learned trial Court shall endeavour to dispose of the same expeditiously preferably on the day of filing of such application while duly considering the medical record as may be shown to the Trial Court.
