Petitioner has prayed for a writ in the nature of certiorari for quashing order dated 26.09.2017 (Annexure P-5) whereby petitioner was retired from the service on attaining the age of superannuation of 60 years as on 30.09.2017. The limited plea of the petitioner is that he needs to be considered for further extension in view of the fact that he is a disabled person. Learned State counsel, however, refutes the claim on the ground that petitioner was initially appointed in the general category and not against a post reserved for disabled person.

This court finds merit in the plea of the State. There is, thus, no ground to interfere. Petition is hereby disposed of. At this stage, learned counsel for the petitioner submits that in view of the latest policy dated 22.05.2017 issued by the government, he may be allowed to file representation.

Liberty as prayed for is granted.
