ARUN MONGA, J. (ORAL) Petitioner herein seeks issuance of a writ in the nature of mandamus directing the respondents to grant him benefit of 1st Assured Career Progression Scheme by considering his application dated 07.10.2020 (Annexure P-4).

Learned counsel for the petitioner submits that petitioner had worked on the post of Junior Engineer from 25.05.2006 to 01.06.2016 and had completed 8 years of service. She submits that as per Rules 2016, the petitioner became eligible for Ist ACP scale. In the premise, petitioner submitted an application dated 07.10.2020 to the respondents to consider his case in terms of the applicable Rules. But the same has not been adverted by the respondents till date. Hence, the instant petition.

Given the nature of order being passed, there is no necessity to seek return by any of the respondents as no further proceedings and/or pleadings are required.

Without commenting on the merits of the case, the writ petition is disposed of with a direction to the competent authority to objectively consider his application/representation dated 07.10.2020 (Annexure P-4) and also by keeping in view the contentions stated in the present petition by treating the same as supplementary representation and decide the same by passing a speaking order, in accordance with law.

Let the needful be done within a period of 3 months from today. 8.

Petition stands disposed of accordingly.
