The petitioner through instant petition under Articles 226/227 of the Constitution of India is seeking directions to respondents to grant place of posting as per relevant rules and regulations. 2.

On 26.07.2023, the following order was passed : "Learned counsel for the petitioner inter alia contends that claim of the petitioner is that he could not join at his fresh place of posting due to denial by the officials of the transferred place of posting. The petitioner is ready and willing to join, however, respondents are neither permitting him to join nor paying his salary.

Mr. Parvesh K. Saini, learned counsel for the respondents seeks time to find out possibility to make the petitioner join."

Learned counsel for the respondents-UOI submits that in view ANJU GOEL 2023.09.22 17:31 I attest to the accuracy and integrity of this document

CWP-19208-2022 -22023:PHHC:125365 of communication dated 28.08.2023 received from the officer concerned, the petitioner is at liberty to join with his parent unit at Roorkee. The authorities would make him to join. He further submits that the petitioner has been declared deserter and proceedings against him would be initiated as per law.

Faced with this, learned counsel for the petitioner would submit that petitioner shall join as directed by this Court, however, inquiry against him, be conducted by an independent officer of the respondent. 5.

In view of statement of learned counsel for the respondentsUOI, the petition stands disposed of. The petitioner is directed to join his parent unit at Roorkee on 03.10.2023 at 10.00 a.m. The respondents without causing any hindrance would make the petitioner to join. The respondent is at liberty to conduct enquiry with respect to absence of petitioner, however, enquiry shall be conducted by an independent officer of the respondent.
