JASWANT SINGH, J. (ORAL) The petitioner is a aspirant for appointment to the post of Medical Officer with the Department of Health and Family Welfare, Punjab, pursuant to the advertisement dated 19.2.2018 (Annexure P2). The petitioner belongs to General Category and 112 posts out of total 306 posts have been advertised in General Category for which the aspirants are required to submit online application form by 28.3.2018.

The essential qualifications prescribed and advertised are as under: - "3.1 M.B.B.S.

3.2 Registered with the Punjab Medical Council or with any other duly constituted Medical Council in India.

3.3 Knowledge of Punjabi Language upto Matriculation Standard or its equivalent. Candidates who do not possess this qualification shall have to acquire this qualification within six moths of their joining the service failing which their services shall be terminated."

The case of the petitioner is that he was provisionally registered with the Punjab Medical Council vide certificate dated 8.9.2017 (Annexure P1) and had applied for permanent registration by post on 20.3.2018 and online on 28.3.2018, with the Punjab Medical Council, in view of the prescribed essential qualification, however, application had bee rejected by the Punjab Public Service Commission, Patiala, on the ground that the petitioner has applied for registration after the cut off date of 28.3.2018.

This Court while issuing notice of motion and subsequently on a misc. application, had directed the Punjab Public Service Commission, Patiala, for permitting the petitioner to undertake the selection process i.e. written test and interview on provisional basis. At the time of hearing today, the result of the petitioner has been produced and on examination of the result, it transpires that the

petitioner has secured a total of 180 marks (156 marks in the written test + 24 marks in the interview), whereas the last candidate selected in the General Category has secured 204.70 marks.

Learned State counsel, in view of the result of the petitioner, states that the issue raised in the petition would be an academic exercise.

In response, learned counsel for the petitioner concedes that nothing more survives for adjudication in the instant writ petition. Dismissed as having rendered infructuous.
