(ORAL) The petitioner herein has preferred the instant petition under Articles 226/227 of the Constitution of India for issuance of an appropriate writ, order or direction to the respondents to consider and promote the petitioner as Tehsildar from the date his juniors were promoted. Learned counsel for the petitioner contends that on date no inqury is pending against the petitioner. The Inquiry which was initiated in the year 2003 against the petitioner was on the ground that he had not submitted the account to the concerned authorities in which he had been appointed as a Receiver in 145 Cr.P.C. has since been completed and he has been exonerated therein. In this regard the petitioner has already submitted a representation/legal notice dated 20.10.2014 to be considered for promotion to the post of Tehsildar but the same has yet to be decided. On asking of the Court, Mr. R.S. Sidhu, learned Asstt. A.G., Punjab accepts notice on behalf of the respondent-State. Let three copies of the petition be served upon him during the course of the day. CWP No. 27313 of 2016 -2Learned counsel for the petitioner submits that the petitioner would be satisfied if a direction be issued to the respondents to consider and decide the aforesaid representation within a time bound period. Without expressing any opinion on the merits of the case, the respondents are directed to consider and decide the representation dated 29.10.2014 (Annexure P-5) within a period of two months from the date of receipt of a certified copy of this order. In case the petitioner is entitled to the promotion sought the necessary orders along with all consequential benefits be released as well. Needless to say before deciding the representation the petitioner be given an opportunity of hearing.
