SURYA KANT, J.(ORAL) The petitioners are closely related as petitioner No.1 is the father of petitioner Nos.2 and 3. Their land measuring 76 kanal 13 marla was acquired by the State of Haryana for the development of residential/commercial Sector-23, Sonepat. The petitioners being 'oustees' applied for allotment of plot measuring 500 square yard to each one of them in terms of the Policy which was in vogue at the relevant time, but HUDA authorities made no allotment. Each petitioner then applied for 250 square yard plot and deposited the requisite earnest money on 25.04.2006, but no allotment has been made so far.

The petitioners approached this Court through CWP No.5109 of 2007 which was disposed of with a direction to decide their claim as per the earlier decision of this Court. The representation of the petitioners was decided vide order dated 23.03.2009 in which the factum of receipt of application from them for 250 square yards plots was duly acknowledged. CWP-22019-2018 -2However, the fact of the matter is that till date, no allotment has been made. In this second round of litigation, the petitioners again seek a direction for allotment of plots.

We have heard learned counsel for the petitioners. In view of the fact that the applications submitted by the petitioners are pending consideration from the last 12 years, it is imperative upon the respondents to take a final decision thereupon. Suffice to observe that if draw of lots is required to be held, such a process be also completed in a time-bound manner. The writ petition is accordingly disposed of with a direction to respondent Nos.2 to 4 to take necessary action and decide the petitioners' claim, keeping in view the judgment of this Court in CWP No.11280 of 2009 (Jagmal Singh and another vs. State of Haryana and others) or other later decisions.
