Petitioner has prayed for a writ in the nature of certiorari for quashing order dated 8.10.2013 (Annexure P8) passed by respondent No.1 whereby he has remanded case to the Deputy Commissioner, Sirsa to ascertain whether the pension amount alleged to have been embezzled was disbursed to family members of the deceased. Counsel for the petitioner submits that once report of Enquiry Officer had become final, there was no ground for respondent No.1 to remand case to the Deputy Commissioner.
I, however, find that respondent No.1 has given cogent reasons for remand of case to the Deputy Commissioner. There is, thus, no interference required by this court, at this stage. In case, the matter is still pending before Deputy Commissioner, he shall also consider version of the petitioner.
Petition is disposed of in above terms.
