**** HARSIMRAN SINGH SETHI J. (Oral) The petitioner is seeking anticipatory bail in FIR No. 113 dated 09.10.2020, registered under Sections 406, 420, 120-B IPC at Police Station Nandgarh, District Bathinda.
Learned counsel for the petitioner contends that the petitioner has joined the investigation in terms of order passed by a Co-ordinate Bench of this Court dated 16.02.2021. Order dated 16.02.2021 is as under:- "The matter has been taken up for hearing through video conferencing due to outbreak of COVID-19.
Learned counsel for the petitioner(s) submit that the money allegedly withdrawn from the account of complainant has already been deposited.
Adjourned to 19.05.2021.
Meanwhile, in the event of arrest of the petitioner(s), they shall be released on ad interim bail to the satisfaction of the arresting officer. However, the petitioner(s) shall join the investigation as and when directed by the investigating agency and shall abide by JYOTI 2021.09.17 16:33 I attest to the accuracy and integrity of this document

Learned State counsel, who is present in the Court, on instructions from HC Gurmeet Singh, states that in terms of the order of Co-ordinate Bench of this Court reproduced before, the petitioner has joined the investigation and challan has not been presented. Learned counsel for the petitioner undertakes that petitioner will join the investigation and also cooperate with the investigating agency in case he is required for the same in future as well.
In view of the above, order dated 16.02.2021 granting interim bail to the petitioner is made absolute. However, the petitioner shall abide by the conditions stipulated under Section 438(2) Cr.P.C. He shall also join investigation as and when called upon to do so.
In case at any given point of time hereinafter, it is felt by the investigating agency that petitioner is required for the investigation but is not cooperating, they will be at liberty to approach this Court for passing appropriate orders.
The petition stands disposed of.
