**** RITU BAHRI , J. (Oral) The grievance of the petitioner before this Court that she was working as Assistant Professor/Extension Lectuter on contract basis and now the respondents vide impugned order dated 14.08.2018 terminated the service of the petitioner by transferring one regular employee in the college of the petitioner.
Learned counsel states that similar controversy has been settled in the case of Vijay Vir where one regular person was transferred against the post of the petitioner who was working on contract basis and on filing CWP No. 4472-2016, this Court directed the respondents not to relieve the petitioner vide order dated 17.03.2016. Thereafter, the case was disposed of in terms of Ms. Menka and others vs. State of Haryana and others, decided on 05.05.2016 and respondents were directed to examine the issue in terms of the above judgment. Further on similar grounds, one CWP No. 4693-2017 was filed by Dr. Neetu and respondent No. 2 cancelled Gaurav Arora 2018.09.04 16:13 I attest to the accuracy and integrity of this document Chandigarh
CWP No. 22042-2018 -2deputation order of regular Assistant Professor, vide Annexure P-15. Notice of motion On asking of the Court, Ms. Palika Monga, DAG, Haryana accepts notice on behalf of the State. Learned counsel for the petitioner is directed to supply copy of the petition to the learned State counsel by today itself.
Without expressing any opinion on the merits of the case, instant petition is disposed of with a direction to respondents to allow the petitioner to work till regular appointments are made and the petitioner shall not be replaced on the basis of transfer of regular employee. However, it is further made clear that if some new regular candidate joins, the petitioner can be relieved, as per Menka'a case (supra). This exercise shall be completed within a period of two weeks from the date of receipt of certified copy of this order.
