JASWANT SINGH, J. (ORAL) Petitioner (Sawinder Singh) while working as Block Development and Panchayat Officer and petitioner (Harvinder Singh) while working as Panchayat Officer, at Sangrur, on 29.7.2008, are alleged to have tampered with the official record with regard to filling up Form No.10, regarding the result of the election of Sarpanch of Gram Panchayat, Bahadurpur. FIR No.14 date 11.2.2010, under Sections 468, 471 and 120-B of the Indian Penal Code, was registered at P.S.Sadar, Sangrur, against both the petitioners.
In the departmental proceedings, based on the inquiry report dated 8.10.2013 (Annexure P15), the punishment of stoppage of two annual grade increments was imposed vide order dated 22.4.2015 (Annexure P16) upon both the petitioners i.e. Sawinder Singh, Block Development and Panchayat Officer and Harvinder Singh, Panchayat Officer.
In view of acquittal of both the petitioners vide judgment dated 15.3.2017 (Annexure P17), they have assailed the punishment order. At the time of hearing, counsel for the parties agree that both the petitions have become infructuous as in appeals filed by both the petitioners, the Government has withdrawn the aforesaid order of stoppage of two annual grade increments.
In view of the agreed stand, both the above petitions are
dismissed as having rendered infructuous.
A copy of the order be placed on the file of connected case.
