The jurisdiction of this Court has been invoked under Article 226 of the Constitution of India seeking issuance of an appropriate writ, order or direction in the nature of habeas corpus, directing respondents No.1 to 3 to produce the detenues, namely Sandeep Singh, son of Sh. Surinder Singh, and Smt. Amarjit Kaur, wife of Sh. Surinder Singh, who are alleged to have been illegally and unlawfully detained by respondents No. 3 to 6.

Vide order dated 25.05.2026, a Warrant Officer was appointed by this Court and he was directed to visit the alleged places of detention and any other place as may be pointed out by the petitioner. 3.

CRWP No.6287 of 2026 -2same is taken on record. As per the report, the SI/SHO furnished statement (Annexure R-1) stating that the alleged detenues, namely Sandeep Singh and Amarjit Kaur, were neither called to Police Station Kahnuwan nor required in any case. A copy of the relevant GD entry has also been annexed with the report as Annexure P-2. The Warrant Officer further reported that during the course of proceedings, the petitioner informed him that the detenues had returned to their home at Jalandhar. Statement of detenue-Sandeep Singh (Annexure P-3) was also recorded, wherein he stated that he and his mother were taken to Police Station Kahnuwan by police officials on 24.05.2026 between 05:00 PM and 06:00 PM and were released on 25.05.2026 at about 09:30 PM. He further stated that the police officials were making inquiries regarding the whereabouts of his brotherin-law, Kulwant Singh. 4.
In view of the report submitted by the Warrant Officer and the statement of detenue-Sandeep Singh indicating that both the alleged detenues have already been released and have reached home, no further cause of action survives in the present habeas corpus petition. 5.
Accordingly, the present petition is dismissed as having been rendered infructuous.
