Having heard learned counsel for the petitioners, but without commenting anything as regards the veracity of averments made in the petition, the instant petition is disposed of with a direction to respondent No.4 - The Superintendent of Police, Police Head Quarter, Tarn Taran, Punjab to ensure that in case any of the petitioner is required to be associated with any inquiry in the capacity of a witness, then a prior notice in terms of provisions of Section 179 of The Bharatiya Nagarik Suraksha Sanhita, 2023 (BNSS) is afforded to the petitioner.

It is, however, made clear that in case the petitioners are required to be associated in the capacity of an accused, it shall be open to the police to proceed further in accordance with law.
